Rule 59
Transfer Agreement to be negotiated

(1) According to sub-section (2) of section 109 of the Act, if a worker wants to be transferred from one establishment to another establishment and the establishment that wants to be transferred wants to keep such worker in its establishment, the worker can be transferred by mutual agreement between the transferring establishment and the establishment to be transferred.< br> (2) The following things should be mentioned in the agreement made according to sub-rule (1):-
(a)   Name, address,
of the transferring establishment and the transferee establishment (b)   the designation, name,
of the person contracting on behalf of the establishment (c) the position, name, surname, address and date of appointment of the worker to be transferred,
(d) wages and benefits received by the workers,
(e) The amount of contribution to be deposited in the Provident Fund and Social Security Fund in the name of the worker to be transferred and the date of deposit of such amount,
(f) Whether or not the period of service of the worker is added to the period of service in the establishment to which he is transferred, and if the period of service is not added, the consent of the worker in that matter,
(G) If the service facility currently received by the worker is less than the service facility provided by the establishment to be transferred, the fact that the worker has consented to such service facility,
(h) Other matters deemed necessary by the parties to the agreement.
(3) A copy of the agreement made according to sub-rule (1) shall be made available by the establishment to the concerned workers.
(4) Notwithstanding anything contained elsewhere in this rule, no worker shall be transferred from one establishment to another establishment without the consent of the worker concerned. But according to the regulations of the establishment related to workers' wages, services and facilities, the employer will not be hindered from transferring the workers working in one workplace to another workplace.
